An off-duty Drug Enforcement Administration officer who was arrested in October for being intoxicated in his truck in a Silverdale parking lot was not charged.

Claire Bradley in the Kitsap County prosecutor's office says it was a close call, but no one saw Matthew Musselwhite drive. He told a Washington State Patrol trooper he went to his truck to sleep and started the engine to run the air conditioning.

The Kitsap Sun reported (http://bit.ly/WmeNC6) the decision Monday. Musselwhite was accused of being in physical control of a vehicle while intoxicated. He could face DEA discipline, but he won't face a criminal charge.
