Judge says Portland officer's home search valid

A federal magistrate Judge has ruled that a search of a Portland police sergeant's home by two fellow officers was valid.

PORTLAND, Ore. —

A federal magistrate Judge has ruled that a search of a Portland police sergeant's home by two fellow officers was valid.

The Oregonian ( http://is.gd/RcJYEU) says the lawsuit filed last year by Sgt. Richard Braskett against the officers culminated this month with the decision by U.S. Magistrate Judge Dennis J. Hubel, who ruled the consent to the search by Braskett's wife was valid and sufficient.

Hubel also ruled the case could not proceed to trial.

Braskett's lawsuit accused the officers of illegally searching his home in Washington state in April 2010 without his consent or a warrant.

Braskett was under investigation at the time for alleged prescription drug abuse.

Braskett completed treatment for alcohol and prescription drug abuse and is back to work as an East Precinct patrol sergeant.
