Pierce County Prosecutor Mark Lindquist says a sheriff's deputy was justified in fatally shooting a man Jan. 31 near Roy as he fired a rifle at the sheriff's department's airplane.
The plane was flying over the home of 50-year-old Raymond LaMadeleine as a SWAT team moved in to arrest him because of threats he had made to neighbors and to deputies if they tried to evict him.
The plane was not hit.
